When were binoculars able to be used by the Navy?

Can you answer amandakelly94's question about Binoculars?:

I have this trial thing i have to do for school. A robbery waws taken place on November 18th, 1805. A gaurd says he has seen two men form 100 yards away(about 300 ft). HE says he could identify one of the two men's features because he had binoculars. My team is defending the man who was accused of treason. Were binoculars able to used by a gaurd who works for the Federal Weapons Warehouse. And what would else help is the year they were invented in.
